Domestic Relations
Many domestic relations cases will require a business valuation for each marital partner. Determining an accurate assessment of value may minimize the need for litigation. If litigation is required, a variety of valuation issues must be considered. Issues include the standard of value, personal goodwill versus enterprise goodwill, fair and reasonable owner's salary, discounts and premiums for minority versus control positions, and lack of marketability to sell the business.
We have extensive experience involving divorce cases. Most cases have settled before litigation, however, we have provided expert testimony in several cases. We represent either the business owning spouse, or the non-business owning spouse and plaintiff or defendant. In several cases, we have been retained as a joint-expert representing both spouses' interests. This stands as a testimony to our unbiased, independent and objective state of mind and approach.
